Questions people ask
How long do I have to file a lawsuit after a car accident in Texas?
Generally two years from the date of the accident for personal injury, under Tex. Civ. Prac. & Rem. Code § 16.003. Some claims — against a government entity, for example — require notice much sooner. Do not wait to find out which applies to you.
Should I talk to the other driver’s insurance company?
Report the claim, but do not give a recorded statement or sign a medical authorization before you have talked to a lawyer. What you say early is used later to value the claim.
What if the other driver has no insurance, or not enough?
Your own uninsured/underinsured motorist coverage may pay. Texas insurers must offer it, and it applies unless you rejected it in writing.
