Construction Litigation

construction litigation

Disputes in the construction business can sometimes seem like the norm. Homebuilders have disputes with buyers, developers have disputes with builders and contractors, and contractors must feel like they have disputes with everyone.

We have extensive experience representing parties in residential, commercial, and industrial construction disputes, including claims for breach of contract, fraud, liens, breach of warranty claims, and tort claims related to the construction process. Many times, these claims are made years after the construction has been completed.

Relevant Experience

We represented a contractor who constructed an industrial building for a furniture manufacturer. The manufacturer claimed that construction defects resulted in damages of over $2 million to the building and its contents. After discovery and expert witness depositions, the matter was settled confidentially on terms very favorable to our client.

We also represented a disaster recovery contractor in a lawsuit claiming that it had failed to pay a subcontractor all amounts due. The subcontractor sought over $1 million in damages, but eventually dismissed the lawsuit and received nothing.

We represented a homeowner in a claim against his builder for defects in construction. Our client recovered a judgment for over $200,000. We then represented the homeowner in a lawsuit brought by his lender. We negotiated a settlement on behalf of the homeowner whereby he paid nothing.
